Violation of this policy by any employee, regardless of seniority, shall be subject to disciplinary action up to and including termination of employment. --- ## 2.0 Definitions and Interpretation ### 2.1 Defined Terms For the purposes of this Manual, the following terms shall have the meanings ascribed below unless the context clearly requires otherwise: **"Affected Employee"** means any employee whose job requires them to operate or use a machine or equipment on which servicing or maintenance is being performed under lockout/tagout procedures, or whose job requires them to work in an area in which such servicing or maintenance is being performed. (Ref.: 29 C.F.R. § 1910.147) **"Authorized Employee"** means a person who locks out or tags out machines or equipment in order to perform servicing or maintenance on that machine or equipment. **"Competent Person"** means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. (Ref.: 29 C.F.R. § 1926.32(f)) **"EHS Manager"** means the individual designated by [COMPANY NAME] as the Environmental, Health, and Safety Manager, holding primary operational responsibility for safety program implementation and regulatory compliance. **"General Industry Standards"** means the OSHA standards codified at 29 C.F.R. Part 1910, applicable to workplaces not otherwise covered by construction, maritime, or agriculture standards. **"Hazard"** means any condition, practice, or procedure that creates a potential for harm, injury, illness, or damage to persons or property. **"Hierarchy of Controls"** means the NIOSH-recognized framework for selecting hazard controls in order of effectiveness: (1) Elimination, (2) Substitution, (3) Engineering Controls, (4) Administrative Controls, and (5) Personal Protective Equipment. **"Imminent Danger"** means any conditions or practices in any place of employment which are such that a danger exists which could reasonably be expected to cause death or serious physical harm immediately or before the imminence of such danger can be eliminated through the enforcement procedures otherwise provided by the OSH Act. **"Incident"** means any unplanned event that results in, or has the potential to result in, injury, illness, property damage, environmental release, or near-miss condition. **"OSHA 300 Log"** means the Log of Work-Related Injuries and Illnesses required under 29 C.F.R. § 1904.7 et seq. **"PPE"** means Personal Protective Equipment, as defined under 29 C.F.R. § 1910.132. **"Qualified Person"** means one who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems relating to the subject matter, the work, or the project. **"Recordable Incident"** means a work-related injury or illness that meets one or more of the criteria set forth in 29 C.F.R. § 1904.7, including medical treatment beyond first aid, days away from work, restricted work duty, loss of consciousness, or diagnosis of a significant illness by a licensed healthcare professional. **"Serious Violation"** means a violation of the OSH Act or any standard, regulation, rule, or order issued pursuant thereto, where there is a substantial probability that death or serious physical harm could result and the employer knew or should have known of the hazard. ### 2.2 Interpretation Unless otherwise specified, all regulatory citations in this Manual reference the current published version of the Code of Federal Regulations. In the event of a conflict between the provisions of this Manual and any applicable federal or state regulation, the applicable regulation shall control.
